Jimmy Savile's Charitable Trust gets Right to Appeal

The Sir Jimmy Savile Charitable Trust has been given the right to Appeal for the reasons below.  This case will be held in London at The Royal Courts of Justice in front of Rt. Hon. Lord Justice Patten. The appeal refers to the decisions made by Justice Sales in March and left the Charitable Trust with £350k Court Costs.

 1. "The Grounds of appeal seem to me to raise properly arguable issues about the nature of the Scheme; whether it provides an appropriate (or necessarily effective) means of dealing with the claims by the PI claimants given the available alternatives; and whether National Westminster Bank has surrendered the need for objectivity in its promotion of the scheme."

2. " The hearing of the appeal is to be expedited and heard during the next term"

  1. Thought this might happen and good it is happening. These PI claimants can't take money that was donated to the Trust by outsiders, that's reprehensible. Those monies aren't Jimmy Savile's personal funds, and should be made available to the charities he designated as soon as possible. I hope Patten has more sense that Sales.

  2. I recall from your past Blogposts on this matter that the reasons for everything in this whole legal shemozzle are something of a Gordian Knot.

What I still find inexplicable is why Nat West insisted on remaining involved when they were so clearly made aware that they were unwelcome by the various folk who had been left the unenviable task of administering the Savile Trust and were bemused to see the Savile Estate about to be denuded on what have always been unfounded and often nonsensical alleagtions. Why did Nat West not simply fold their tents and walk away? They must have some angle of their own that far outweighs what really has only been bad publicity and aggravation for them.

    1. My experience has been via several will disputes is that trustees if they are banks/ solicitors will cling on for grim death for the obvious reasons : they cannot lose and are paid out of the estate.
As I feared with this attack upon Savile's estate, it will be eaten up by legal disputes and go on for years.
My own solicitor when drawing up my will even placed a codicil for removing trustees in certain circumstances such as this.

  3. None of these scammers should get one penny piece. Nat West should sod off and the abuse lawyers should be put out of business for their fraudulent activity. Bring it on eh !

  5. I should add : I believe Slater & Gordon will also be paid out of the estate and I predict claimants will receive almost nil.
Something for future debates will be the fact that trustees, all lawyers had a field day and profited handsomely whilst claimants of any description received nothing.

    1. Oh I don't know. I think a good smacking would be appropriate. Perhaps being forced to write out lines. 50,000 "I will not tell lies" maybe?
